This Maker Agreement (“Agreement”) is between WowMake LLC (“WowMake,” “we,” “us”) and you (“Maker,” “you”) when you list handmade, made-to-order, or finished goods for sale on WowMake’s handmade marketplace. It supplements our Terms of Service. By listing products, accepting orders, or receiving payouts, you agree to this Agreement. It does not cover print-on-demand products where WowMake is the seller of record.
1. Your role as an independent seller
- For each handmade marketplace order you accept, you are the seller of record. WowMake provides the storefront, payment processing, and payout tools, but does not make, inspect, or certify your products.
- You appoint WowMake as your limited payment collection agent, solely to accept buyers' payments for your marketplace sales on your behalf. A buyer's payment to WowMake is treated as payment made directly to you: once WowMake receives it, the buyer's payment obligation to you is satisfied, even if WowMake has not yet paid your proceeds out. WowMake pays your proceeds, after commission and any amounts this Agreement allows it to withhold or recover, to your connected payout account as described in section 4.
- You are an independent seller—not a WowMake employee, agent, or partner. You are responsible for how you make, price, package, and ship your products, and for following applicable product-safety, labeling, consumer-protection, and tax rules where you sell and ship.
- You must have the rights needed to sell each item you list, including rights to any designs, photos, names, or brands you use.
- Who may sell and receive payouts is set out in our Terms of Service.
2. Getting paid & tax information
- To receive payouts, complete payout onboarding through our payment partner (Stripe Connect), including any identity and tax forms they require.
- Where the law requires, WowMake may collect and remit sales tax on sales made through the marketplace. That does not replace any income-tax obligations you may have.
- Keep your payout profile up to date. Orders or payouts may be delayed until onboarding is finished.
3. Commission & fees
WowMake charges a platform commission on handmade marketplace sales. Your applicable rate and any volume-based tiers are shown in Maker Hub and may change with notice for future orders.
- Commission is calculated on the amount the buyer pays for the item after discounts.
- Check Maker Hub for your current rate, tier status, and any promotional adjustments.
- Payment-processing fees charged by our payment partner are separate from platform commission.
- Payout minimums, if any, are shown in Maker Hub and may also depend on our payment partner’s requirements.
4. Order acceptance & payout timing
After a buyer pays, funds for your sale are held until the order progresses through acceptance, fulfillment, shipping, and delivery. Maker Hub shows each order’s status.
- Accept new orders by the deadline shown for that order in Maker Hub. Orders you do not accept in time may be cancelled and refunded to the buyer.
- Your proceeds (after commission) stay held while you fulfill and ship the order.
- When there is no dispute, payout to your connected payout account follows the schedule shown in Maker Hub after delivery is confirmed. WowMake may release funds earlier for sellers in good standing.
- Upload accurate tracking as soon as you ship. Payout timing depends on delivery being confirmed.
5. Disputes, chargebacks & refunds
- If a buyer opens a valid dispute or chargeback, related funds stay on hold until the matter is resolved.
- If the outcome is against you, those funds go back to the buyer and are not paid to you. If you already received them, WowMake may recover the amount from later payouts, remaining held funds, or other lawful means.
- You can share tracking, photos, and messages through Maker Hub to support your side of a dispute.
- Refund decisions follow our Returns & Refunds policy. As the seller of record, you agree to cooperate.
- Repeated disputes or quality issues may lead to holds on payouts, removal of listings, or account limits.
6. Listing standards
- Describe materials, size, production time, and customization options accurately.
- Do not claim handmade status, certifications, or approvals you do not have.
- Do not list counterfeit goods, unlicensed branded items, or products that are illegal where you ship.
- You are responsible for copyright and rights statements you make when you publish a listing.
7. Cancellations & customer service
- Buyers should contact you first about order questions. WowMake support may step in under our Returns & Refunds policy if you do not respond.
- If you need to cancel after accepting an order, do so promptly in Maker Hub. Frequent late cancellations may be treated like repeated disputes.
8. Suspension & ending sales
WowMake may suspend selling, hold or reverse a payout, or close selling access if you break these terms or the law, have repeated disputes, lose payout eligibility with our payment partner, or list fraudulent, unsafe, or infringing products.
You may stop selling at any time. Orders you already accepted must still be fulfilled or properly cancelled. Held funds for completed, undisputed orders continue on the normal payout schedule. Funds tied to an open dispute stay held until that dispute is resolved; amounts owed to the buyer are not paid to you.
9. Responsibility for claims
You agree to protect WowMake from claims that arise from your listings—including intellectual-property claims, product defects, safety issues, and inaccurate descriptions—to the extent allowed by law. Limits on WowMake’s liability in the Terms of Service also apply to this Agreement.
10. Changes to this Agreement
We may update this Agreement and will notify you through Maker Hub or email. If you keep listing or selling after a change takes effect, you accept the updated terms.
11. Governing law
This Agreement is governed by the laws of the State of Wyoming, United States, consistent with our Terms of Service.
